These Terms & Conditions (“Terms”) apply to your use of apexbiolabs.com.au (the “Site”) and to all orders placed with Apex Biolabs, ABN 30 673 462 300 (“Apex BioLabs”, “we”, “us”). By using the Site or placing an order, you agree to these Terms.
1. Research use only
All products are supplied for laboratory research use only, on the terms in our Research use page, which forms part of these Terms. Products are not for human or veterinary consumption.
2. Eligibility
You must be at least 18 years old and have legal capacity to enter into a contract. You must not order if supply of the products to you is prohibited by the law that applies to you.
3. Orders and acceptance
An order is an offer to buy. A contract is formed only when we dispatch the products or send you a dispatch confirmation. We may decline any order, including where a product is unavailable, the price is displayed in error, or we suspect the order is not for research use.
4. Prices and payment
Prices are in Australian dollars (AUD). Shipping costs are shown at checkout before you pay. Payment is taken through our payment provider(s); we do not store full card details. Orders paid by bank transfer are dispatched once funds clear.
5. Shipping and risk
We ship within Australia only. Delivery estimates are not guaranteed. Title and risk pass to you on delivery to the address you provide. Please see our Shipping policy.
6. Returns, refunds and the Australian Consumer Law
Our goods come with guarantees that cannot be excluded under the Australian Consumer Law. You are entitled to a replacement or refund for a major failure and compensation for any other reasonably foreseeable loss or damage. You are also entitled to have the goods repaired or replaced if the goods fail to be of acceptable quality and the failure does not amount to a major failure. See our Refund & Returns policy.
7. Product information and test reports
We take care to describe products accurately. Third-party test reports relate to the sample tested, as identified on the report. Nothing on the Site is a representation about the effects of any product in humans or animals.
8. Limitation of liability
To the extent permitted by law, and subject to your rights under the Australian Consumer Law, we are not liable for any loss arising from the use or misuse of products contrary to these Terms, including any use other than laboratory research. Where our liability cannot be excluded but can be limited, it is limited to resupplying the goods or paying the cost of resupply.
9. Your warranties and indemnity
You warrant that the information you give us is accurate and that you will comply with the Research use terms. You indemnify us against loss arising from your breach of these Terms or misuse of the products, to the extent permitted by law.
10. Accounts
You are responsible for keeping your login details confidential and for activity on your account.
11. Intellectual property
Site content, including text, images and branding, belongs to Apex BioLabs or its licensors and may not be reproduced without permission. Third-party test reports remain the property of the issuing laboratory.
12. Privacy
We handle personal information in line with our Privacy policy.
13. Changes
We may update these Terms. The version published when you place an order applies to that order.
14. Governing law
These Terms are governed by the laws of New South Wales, Australia, and the courts of that jurisdiction have non-exclusive jurisdiction.
